Kotomitsuki accused of gambling- dismissed from Sumo

Another session, another postponement. "My client couldn't care less about the money-it's about reinstating him at his Ozeki position. He is adamant about it. so that's that," said, yet again, Kotomitsuki's lawyer Ben Goshi at the hearing today. Next date-February 8th, more oral proceedings and Mr. Tamiya aka Kotomitsuki is expected to make an appearance.

Oral pleadings today in court at the lawsuit of the former Kotomitsuki for protest against his dismissal and having his ozeki status acknowledged. He (Mr. Tamiya) and Dewanoumi-riji for the NSK appeared as witnesses.
As the reason why he admitted to have down gambling, after having denied it at first, he named that the rijicho (then Musashigawa) himself had told him he would get out of it with a stern warning only.
Dewanoumi-oyakata then was senior executive manager. He stressed the fact that K. had denied at first and said "the gravity and scale of the matter made a dismissal inevitable."
After Sokokurai getting reinstated, this case has become interesting.

I don't see how Kotomitsuki's case has become interesting just because Sokokurai was reinstated. Sokokurai always denied that he participated in fixed bouts, whereas Kotomitsuki admitted he ran up large gambling debts (and to people connected to the yakuza too, I believe). Kotomitsuki is protesting the penalty, not denying the behavior that resulted in the penalty, and that's a major difference. I don't see how he's getting off the hook, even if he was mislead as to the punishment that would result from his confession (or admission, if you prefer).

Then kyokai no. 2 Dewanoumi had decided on the dismissal: "He lied at the riji-kai."
Tamiya: "I heard rumors that from the beginning I and Otake-oyakata were to be fired. Only speculations, but I think it was for having voted for ichimon-traitor Takanohana-oyakata at the 2010 riji elections."

The Kotomitsuki trial continued on the 4th. No concessions by either side, no compromise settlement. On July the 18th is the last day of the hearings, as early as for the first half of August a verdict can be expected. Sokokurai's case gave the Kotomitsuki side hope, but they admit that it's extremely exceptional. Usually this kind of trial should end with a compromise. Both demands at the same time will never succeed, which are "invalidity of the dismissal" and "affirmation of the ozeki rank".

Judgment: Kotomitsuki's discharge was not too harsh, his demand was rejected. He wants to appeal to the Tokyo High Court.

When I see talk of Goeido and Okinoumi being possible candidates for Ozeki, I just wonder how much shit would hit the NSK fan if either was to be promoted to the rank.
