Takanohana Wins Yaocho Case

Takanohana oyakata and his wife won their defamation suit against Weekly Shukan Shincho magazine over their article accusing Takanohana of committing a yaocho in his Yusho kettei-sen bout against his brother, then Ozeki Wakanohana at the 1995 Kyushu Basho. The magazine reported Takanohana was ordered by his shisho and father Futagoyama oyakata to let his brother win.

The court concluded that the article lacked any factual evidence and was not based on truth. The court ordered the publisher to pay 3 Million Yen to the oyakata and 750,000 Yen to his wife for damages and print an ad in the magazine to issue a public apology.

Takanohana oyakata personally appeared in the court stating he was never involved in any bout considered to be yaocho. The judge was especially upset with the magazine editors for covertly photographing Takanohana in the court room and subsequently publishing the photo.

The magazine indicated they would file an appeal.

Takanohana oyakata is currently suing another magazine, Weekly Shukan Gendai as well over a similar article claiming he committed yaocho against his brother. He is scheduled to appear in the court on February 16.

why are the sums of money so very low? ....in the US defimation of character/slaner in media generally gets you a lot more, like what he got plus a zero or two on the end.

They asked for 10 times more. It's just that the judge didn't give them the full amount. He figured their mental anguish was not as much considering all the hoopla going on with Ozumo at the moment.

thats pretty crappy of the judge, since the alligations basically boil down to "you are a cheater and your whole career is tainted, or you actually earned everything you got in sumo without cheating" it is either a validation or a discredit to his entire career(because once you have the stigma of being involved in cheating, everyone will wonder if the rest of what you did was because of cheating also). apparently the judge doesnt think of it that way.

Publisher ordered to pay Y8.47 mil to Takanohana in libel suit

The Tokyo High Court ordered major publisher Kodansha Ltd and its president among others Wednesday to pay a total of 8.47 million yen in libel damages to sumo stablemaster Takanohana and his wife, determining that their magazine articles on the couple lacked grounds.

Most of the 13 articles published in the weekly Shukan Gendai and monthly Gekkan Gendai in 2004 and 2005 about sumo wrestling match-fixing scandals and family troubles related to inheritance from Takanohana

There may have been other developments in between that weren't covered on the forum, but in any case Takanohana and wife just lost their final appeal to the Supreme Court to have the higher amount of damages acknowledged. The overall verdict against Shukan Shincho stands, however, and the couple have been awarded 3,250,000 yen now.
