Asashosakari 20,336 Posted October 4, 2013 Kasugayama-oyakata (Hamanishiki) is sued by the former Kasugayama (Kasugafuji) for not paying the rent of the heya. How timely, what with the Kyokai about to start checking for oyakata who have hidden kabu loan arrangements...
shumitto 419 Posted October 4, 2013 (edited) Kasugayama-oyakata (Hamanishiki) is sued by the former Kasugayama (Kasugafuji) for not paying the rent of the heya. I have it on a reputable source that Hamanishiki owes the equivalent of 3 basho, or 6 months worth of rent. :-P Edited October 4, 2013 by shumitto
Akinomaki 41,900 Posted October 19, 2013 Kasugayama-oyakata (Hamanishiki) is sued by the former Kasugayama (Kasugafuji) for not paying the rent of the heya. The former Kasugayama demands from the present to leave the premises and pay 2.87 million yen. The rental contract was renewed this year, he had paid a rent of 600 000 Yen per month last year. New for the 5 store building with the keiko ground and the 2 store dwelling combined 1.34 million yen a month. The new rent was paid till April, then only the old rent. The former K. canceled the contract on August 29th. The present K. interviewed by the NSK, which pays him heya maintenance costs etc., denied the non payment. http://hochi.yomiuri.co.jp/sports/sumo/news/20131018-OHT1T00194.htm
Kintamayama 47,442 Posted November 8, 2013 (edited) The new myoseki ownership rules say the whole kabu thing will be in the hands of the Kyokai from January. The Kyokai has asked all owners to submit their deeds by December 20th. Kasugayama Oyakata (Ex-Hamanishiki) inherited the heya in February of last year but the deed is still in the hands of e ex-Kasugayama, who later became Ikazuchi and stayed on at the heya as a coach and then left the Kyokai for "personal reasons". The deed was given to Ikazuchi last September for safekeeping with the understanding that he will hand it over to the current Kasugayama when the time comes. The time came, but no deed. "I have been attempting to contact him, but to no avail. It was a bad decision to give it to him.." said Kasugayama Oyakata at a press conference today. Ex-Ikazuchi is suing Kasugayama for back payment of rental fees, and is maintaining that this is the reason he isn't handing over the deed. So, trial. Kitanoumi rijicho intends to get to the bottom of this in the coming days when he will meet with Kasugayama Oyakata and see what's what. "A myoseki is something that should be in one's possession the minute one inherits a heya. I will have to seriously look and see why this is not the case here.. " said a visibly (well..) angry rijicho. Edited November 8, 2013 by Kintamayama

Akinomaki 41,900 Posted November 10, 2013 The Kasugayama myoseki certificate had been reissued once at the request in May of the present oyakata who cited that the former refused to hand it over. But in July this was revoked, the original became valid again. Details are contradictory from the sides of the NSK and the heya.If the oyakata can't present the kabu till Dec. 20th he will get into trouble with the NSK – up to losing his status as oyakata in the new NSK public interest corporation. Kitanoumi: “It won't be reissued, because it's not lost.”The oyakata plans to present the case against the former K. etc. to the court on the 11th. He had the certificate in his hand only one day, Sept. 26th last year when applying to the NSK for the myoseki name change. The former then said to him: “I guess you don't have a place to deposit it, so I'll keep it in my safe.” After that he refused to return it, apparently it has been used as security for a loan and been handed to a 3rd party. The former had left the NSK after talk of irregularities in accounting and an affair with a female staff member of the kyokai in Sept. last year.http://hochi.yomiuri.co.jp/sports/sumo/news/20131109-OHT1T00210.htmhttp://www.sponichi.co.jp/sports/news/2013/11/10/kiji/K20131110006981290.htmlhttp://www.tokyo-sports.co.jp/sports/sumou/202975/the former
Akinomaki 41,900 Posted November 11, 2013 The Kasugayama side filed the suit on the 11th. The former K. having given the myoseki certificate to a 3rd party and using it as security for a loan is both forbidden by NSK rules. On the same day the other trial had the first oral proceedings at the same court. The judge suggested a settlement, the Iwanaga side (former K.) announced that a settlement is impossible, the mutual trust being damaged. The Kasugayama side was absent. http://www.sponichi.co.jp/sports/news/2013/11/11/kiji/K20131111006993490.html
Akinomaki 41,900 Posted December 21, 2013 Kasugayama-oyakata will battle it out in court with the former K. - first oral proceedings were today. The former K. admitted to have used the certificate as security for a loan and still claims it to be legitimate – though forbidden by kyokai rules. The former K.'s side (4 people) claims they have records about a loan of 50 million Yen to the present K. on succession to the heya etc. The certificate as being the object of the conflict has been given to the attorney. http://hochi.yomiuri.co.jp/sports/sumo/news/20131220-OHT1T00197.htm Thus the situation is that the former K.'s side has kept it arbitrarily as security for the loan to the present K. - I guess the kyokai rule forbidding to use it as security was rather meant to not give it away for that purpose – difficult to decide who violated the rule in this case. Asameshimae 220 Posted July 12, 2014 (edited) It's hard to believe the kyokai didn't take control of this a long time ago. In Japan, and even more in the hermetically sealed world of sumo, opacity, collusion, and conflict of interest are still not seen as inherently bad things. I guess if the kyokai will now be directly overseeing myoseki maybe things can change. Edited July 12, 2014 by Asameshimae
Akinomaki 41,900 Posted March 6, 2015 At the trial for getting the kabu, the Iwanaga side produced a document that calculates the value of an oyakata kabu to about 180 million Yen. And they also calculated that ex-Kasugayama in 35 years as oyakata (intai at 30) till his retirement would have earned 430 million yen from the NSK. 260 million yen more than the average civilian. http://mainichi.jp/sports/news/20150304k0000m050092000c.html http://www.sanspo.com/sports/news/20150303/sum15030319230003-n1.html The 2 articles mix-up the 2 Kasugayama-oyakata and also seem to differ on the calculation of the kabu value. Mongolith 51 Posted March 6, 2015 I disagreed about the necessity of the kyokai overseeing the transfer of elder stock. Thought they had learned after Wajima got kicked out. Guess I was wrong and this change is needed.

Asashosakari 20,336 Posted March 23, 2015 (edited) News from the heya rental charges trial (which I guess is handled separately from the kabu issue): As requested by ex-Kasugayama, the court is about to start seizing now-Kasugayama's oyakata salary and other income. This is actually the second time such a decision is imminent - the first time around back in July, now-Kasugayama deposited the outstanding rental fees into a trustee account, which satisfied ex-Kasugayama and the court for the time being, and the two parties began to discuss an out-of-court settlement of the lawsuit. That has apparently broken down since then and we're back to square one, just with (I guess) even more unpaid heya rent at stake now. The (old) rent of 600 000 Yen per month is paid for the 29 months since May 2013, when Kasugayama stopped paying (a difference to what was reported before), 17.4 million Yen. "A satisfying settlement has been reached" The other trial for getting the kabu back continues. http://www.nikkansports.com/battle/sumo/news/1493688.html http://mainichi.jp/sports/news/20150618k0000m050023000c.html Edit:It is unlikely that Kasugayama didn't pay anything at all for that 29 months. If we assume he paid 600 000 like reported above, he would end up with paying 1.2 millions a month instead of the 1.34 million new rent demanded and having to leave: more or less utter defeat for him. Maybe in return he gets the kabu cheap. Edited June 18, 2015 by Akinomaki

Maybe in return he gets the kabu cheap. Assuming that's accurate - paying only around 80% of the originally demanded rent increase seems like a good deal to me. On top of that, it seems he's avoiding a late payment penalty through the settlement, so all told I'd estimate he's paying about 5 million yen less than full rent + late fees would have been. I doubt he had any expectation to be able to stay in the dwellings post-trial, so the fact he's having to vacate isn't very relevant.
Akinomaki 41,900 Posted September 23, 2015 The contract to rent the premises is canceled as of end of September, Kasugayama-beya leaves till then and moves to a yet undisclosed location. The heya had problems to find a new location, but locals also helped the only heya in Kanagawa prefecture to move only within the same Kawasaki ward of Kawasaki city. In the ground floor of a former storehouse, partly renovated, the building owned by a construction material company. It will be possible to watch asa-geiko, which goes till 10 a.m. The dohyo is planned to be ready this month, at the dohyo side railings will be installed for the fans to be able to watch safely (no increased risk of injury for the rikishi?). http://www.yomiuri.co.jp/local/kanagawa/news/20150921-OYTNT50319.html The oyakata looking at the keiko ground in the new location on Sep. 13th

Akinomaki 41,900 Posted October 5, 2015 The 2nd time this week I encounter that shinji (Shinto ritual):Kasugayama-beya had such a shinji at the new location yesterday. I don't think this is done any time just the dohyo is renewed, only if a new dohyo is created at a new location, to pray for a successful restart of the rikishi etc. The heya has rented the 1st and 2nd floor of the former storehouse, tatami mats and a bath have newly been installed. The chief priest of the Saka shrine in Saga-city where they stay for Kyushu has written the heya nameplate. Keiko is planned to start when the dohyo is dried up, around tomorrow.http://www.tokyo-np.co.jp/article/kanagawa/list/201510/CK2015100502000155.html
